RULES & REGULATIONS OF HOLY MARY
MOTHER OF GOD CEMETERY

In the following document, Holy Mary Mother of God Cemetery will be referred to as "CEMETERY". The Rules and Regulations are founded solely upon the idea that those who have selected or will select burial spaces in the Cemetery as the final resting place of their revered dead will wish to see the preservation, on a perpetual basis, of the dignified and peaceful atmosphere that presently prevails. These Rules and Regulations have been duly adopted and will be carefully observed and enforced, and will be changed, or repealed, only if and when the necessity should arise and such changes will be done by the CEMETERY, as owner, deems such action is necessary or desirable, in order to preserve and continue the values above enumerated.

These Rules and Regulations shall apply, not only to all the owners of the rights of interment within CEMETERY but also to all visitors, employees and any others who may enter the grounds.

USE OF CEMETERY

1. Persons, while within the cemetery, shall use the roadways as provided by CEMETERY, all of which are and shall remain private roadways and may be changed by the CEMETERY from time to time.

2. Automobiles and other vehicles shall be driven solely on the roadways and in a manner which provides for the safety of persons and property. The roads may be used for visitation only or while conducting business while attending a funeral and are not available for public parking.

3. CEMETERY reserves the right from time to time to enlarge, reduce, re-plat or change the boundaries and/or grading of the cemetery, as well as any portion or portions therof and, to modify or change the locations of, or remove or re-grade any of the roadways within the cemetery, and to lay, maintain and operate or alter or change any pipes, including drainage pipes and/or electrical lines, within the cemetery. CEMETERY may use any portion or portions of cemetery property that has not theretofore been sold to individual owners for the right of interment in connection with the operation of the cemetery.

4. Children will be accompanied by adults at all times.

5. No dogs or pets will be permitted in the cemetery except as may be needed to assist a handicap person while visiting the cemetery.

6. No bicycles or motorcycles shall be admitted or permitted into or operated upon the cemetery property, except in the attendance of a funeral or having legitimate visitation or business in the cemetery.

7. No peddling or offering for sale or selling of flowers, plants, commodities, services, trinkets, souvenirs, pictures, etc.. shall be permitted within the cemetery and no solicitation of any kind may be done within the cemetery.

8. No signs, notices or advertisement of any kind shall be placed within the cemetery, unless the same are placed by CEMETERY or with its permission.

9. No food stuffs, soft drinks, dairy products, beer or intoxicating liquors shall be allowed in the cemetery.

10. No boxes, shells, toys, discarded glassware, sprinkling cans, receptacles or containers not authorized by the CEMETERY shall be brought into or placed within the cemetery.

11. No person shall enter or leave the cemetery, except by use of the private entrances furnished by CEMETERY for the use of the public.

12. Any unauthorized person who is found within the cemetery after visiting hours will be considered a trespasser, since it will be the policy of CEMETERY, in an effort to prevent pilferage, theft, vandalism and the possible desecration of a memorial, to keep the cemetery closed at a reasonable time each twenty four (24) hours, such closing time to be specified by CEMETERY.

13. No person shall be permitted to use profane, obscene or boisterous language, or in any other way disturb the quiet or good order of the cemetery.

14. CEMETERY considers that it is of the utmost importance that there should be strict observance of all due properties, whether embraced in the Rules and Regulations or not; and no improprieties will be tolerated.

USE OF RIGHTS OF INTERMENT OR MEMORIAL

1. The right to use any memorial shall be limited to the interment of the remains of the human dead, regardless of the nature, right or extent of ownership of the memorial.

2. CEMETERY is not an insurer; nor will it be responsible for the loss, theft or damage to any thing that may be placed on or in connection with a memorial, whether the same be placed with or without the permission of CEMETERY.

3. CEMETERY will always respect the private property of the owner of a memorial within the cemetery and will, at all times, refrain, as far as possible, from unnecessarily touching or handling the property of others within the cemetery; and all other persons who enter the cemetery will be expected to do likewise.

4. Each owner is vested with the ownership of his/her right of interment or memorial for the sole purpose of the interment of dead human bodies. However, the rights of interment or memorials may be transferred only with the consent of CEMETERY. No use, division or improvement may be made without the approval of CEMETERY.

5. CEMETERY complies with all laws applicable to the governing of cemeteries in the State of Louisiana.

6. Rights of interment may be purchased in the Cemetery and are subject to the Rules and Regulations, as hereafter may be amended and for the purpose of interment only.

7. CEMETERY must be notified whenever memorials are to be installed in the cemetery so that it will be assured that memorials are installed on the proper interment space and also does not exceed the size provided for in the interment space. No footstones are allowed in the cemetery.

8. In order that improvements in certain additions be kept uniform, Cemetery reserves the right to regulate the size of all markers, monuments and other construction of any grave or lot in said cemetery and to prevent the erection of any monument or obstruction which may conflict with the regulations or which may be injurious to the general appearance of the ground and to remove the same, if necessary.

9. All trees, shrubbery or flowers growing or planted in cemetery shall remain the property of the cemetery and cannot be removed without the written consent of Cemetery. Only employees of Cemetery may embellish the grounds of the cemetery unless prior written permission is given by Cemetery.

10. Any interment space transferred to anyone other than the original purchaser is not valid unless said transfer has been recorded on the books of the Cemetery.

11. No dis-interments may be made without the written consent of the Cemetery.

12. No copings, benches, ornaments or similar objects are allowed in the cemetery without the consent of Cemetery.

13. No gravel or shells or sand are allowed on interment spaces.

14. Upon transfer of ownership, whether by sale, donation, inheritance or any other means there will be a perpetual care fee payable to Holy Mary Mother of God Cemetery. The fee will be the difference between what was originally paid and the present fee being charged. For Mausoleum crypts a 3% annual increase will be charged from the date of the original perpetual care fee.

15. All Opening and Closings for the burial of human remains will be performed by Holy Mary Mother of God Cemetery or those approved to do such work.

16. All flowers must be placed in a vase. Flowers will be removed from vases when they wither. Other flower arrangements must be placed on top of the marker they are intended for. Flowers brought to the grave from the funeral home will be removed within 2 days following burial.

17. Flowers blown from vases will be placed in a nearby vase if the flowers are still presentable otherwise they will be discarded.

18. The cemetery is not responsible for stolen vases or flowers.

19. All information either letters, emblems, pictures placed on crypt fronts in the Mausoleum must be approved by the cemetery authority. A flower vase can be attached to the crypt front, but everything else is to be sandblasted.

All of the above Rules and Regulations are in force as of the date, 5/2007. They are subject to amendments from time to time as Cemetery sees the need arise.

RULES & REGULATIONS OF
LAFAYETTE MEMORIAL PARK CEMETERY

1. Reservations made to enlarge and otherwise change or improve the cemetery and for purposes of passage to and from other lots.

2. The cemetery shall issue a Warranty Conveyance to new owners duly approved by the cemetery and, the rights of approval shall apply in all cases of assignment of conveyances.

3. Cemetery may refuse consent to transfer or assignment of conveyances when original indebtedness remains unpaid. Transfer subject to a charge of $55.00 payable at time of recordation.

4. Upon transfer of ownership, whether by sale, donation, inheritance or any other means there will be a perpetual care fee payable to Lafayette Memorial Park Cemetery. The fee will be the difference between what was originally paid and the present fee being charged. Single Interment Lots will be half of the Standard Lot fee. For Mausoleum Crypts a 3% annual increase will be charged from the date of the original perpetual care fee.

5. Landscaping, care of lots and improvements shall be in exclusive charge of cemetery employees except where permission is otherwise granted by the superintendent of the cemetery.

6. No fence or other enclosure allowed around graves, mounds will not be allowed, and no lot shall be raised above established level.

7. Interment rights can not be sold, transferred, pledged or hypothecated without the written approval of the corporation.

8. Care of cemetery grounds assumed by cemetery under perpetual care trust agreement.

9. Superintendent of cemetery vested with rights to make improvements within the grounds and upon lots such as by planting, sodding, and surveying.

10. All opening and closings for the burial of human remains will be performed by Lafayette Memorial Park Cemetery.

11. Any merchandise purchased by a dealer other than Lafayette Memorial Park Cemetery will pay the same installation fee that would have been charged by Lafayette Memorial Park Cemetery.

12. Not more than one grave memorial will be permitted on one grave space and not more than one family name shall be permitted on said memorial unless otherwise approved by the cemetery, and all memorials are to be set in lines to conform with the plan of the cemetery.

13. Bronze markers for individuals shall be no smaller than 24" x 14" and for a companion no smaller than a 16' x 24'.

14. Use of urns and vases to be selected through the cemetery or approved by it.

15. Marking of lots restricted to flat bronze on a granite base.

16. Markers previously placed on cement bases can remain even though they may have to be refurbished.

17. All flowers must be placed in a vase. Flowers will be removed from vases when they wither. Other flower arrangements must be placed on top of the marker they are intended for. Flowers brought to the grave from the funeral home will be removed within 2 days following burial.

18. Flowers blown from vases will be placed in a nearby vase if the flowers are still presentable otherwise they will be discarded.

19. The cemetery is not responsible for stolen vases or flowers.

20. Flowers will be removed annually if not changed.(mausoleum)

21. All information either letters, emblems, pictures placed on crypt fronts in the Peace Chapel Mausoleum will be sandblasted only. No other articles of any kind may be attached to a crypt front. All flowers are to be placed on the flower tables provided.

22. All interments shall require a vault. Minimum vault is a reinforced concrete vault (no vault required for cremated remains).

23. Cemetery has authority to decide up to time of service whether service will be held at grave, mausoleum or other area based upon weather or other unknown circumstances. Cemetery will make every effort to let Funeral Home know of any changes in service location.

24. Interments cannot be made on Sundays or any of the following Holidays: New Years Day, Mardi Gras, 4th of July, Labor Day, Thanksgiving Day, Christmas Day and Good Friday.

25. All funeral services, including graveside services are to be scheduled no later than 3:00 p.m. (Funeral Time).

26. Once funeral procession enters cemetery, 45 minutes will be allowed before cemetery proceeds to perform its closing services or 20 minutes after Funeral Home has announced that its services have been completed, whichever time comes earlier. If family is still present, Cemetery will approach family or remaining guests to see if they wish to view the remains being buried or if they wish to leave.

27. Scattering of Cremated remains are not allowed in Cemetery except in a designated grave owned by an individual and authorized by the cemetery.

28. Right reserved by cemetery to make and change rules and regulations pertaining to use or beautification of the cemetery.
